Massachusetts Asbestos Regulation

The Massachusetts Asbestos Regulation has established new requirements for asbestos management in renovation and demolition work.

The Massachusetts Asbestos Regulation complies with the requirements of the federal Asbestos National Emission Standard for Hazardous Air Pollutants – more specifically, 40 CMR Part 61, Subpart M with specific requirements for the state of Massachusetts.

The Massachusetts Department of Environmental Protection (MassDEP) wants to amend its Asbestos Regulation into two phases. According to the MassDEP, During Phase 1, they will address issues that have been raised by stakeholders including:

  • The newest section 310 CMR 7.15 (12A) contains requirements for addressing repair and replacement of underground asbestos-cement pipes that are owned by both public and private utilities. These amendments will greatly improve the certainty for both operators and owners of these pipes and will also bring more efficient and less costly projects where any of these pipes need to be repaired or replaced. They will also facilitate improvements in Massachusetts utility infrastructure while protecting the environment and the public from any released asbestos fibers.

In Phase II, the MassDEP will address broader issues that have been raised through the EO 562 public process by current stakeholders. Between the months of April and May 2016, there has been a total of three stakeholder meetings, and the MassDEP is considering ways to address these issues that will be open to public comment at a later time.
